Terms of Service

By accessing or using Cincht's WhatsApp Business Platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

Cincht provides a platform for businesses to manage WhatsApp Business communications, including messaging, automation, CRM, and analytics features. The Service requires a valid WhatsApp Business API account and compliance with Meta's terms and policies.

To use the Service, you must:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Be at least 18 years old or have parental consent

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Send spam, unsolicited messages, or engage in harassment
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service
• Use the Service for illegal or fraudulent purposes
• Violate Meta's WhatsApp Business policies
• Interfere with or disrupt the Service

Subscription fees are billed in advance on a monthly or annual basis. WhatsApp message costs are charged separately based on usage. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

You are responsible for all taxes applicable to your use of the Service. We reserve the right to change our pricing with 30 days' notice.

The Service and its original content, features, and functionality are owned by Cincht and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you create using the Service. By using the Service, you grant Cincht a license to use, store, and process your content as necessary to provide the Service.

Your use of the Service is also governed by our Privacy Policy. We process your data in accordance with applicable data protection laws, including GDPR, CCPA, and other regional regulations.

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Either party may terminate this agreement at any time. Upon termination, your right to use the Service will immediately cease. We may terminate or suspend your account immediately for violation of these Terms.

To the maximum extent permitted by law, Cincht shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

You agree to indemnify and hold harmless Cincht from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
